DMCA Notice & Takedown Policy
Welcome to Clayi (accessible via https://clayi.com). We respect the intellectual property rights of others and expect our users and contributors to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond expeditiously to claims of copyright infringement committed on our platform if such claims are reported to our designated copyright agent.
1. Compliance with the Digital Millennium Copyright Act
Clayi operates as an online service provider offering user-submitted content, software snippets, technical repair files, and digital tools. We comply strictly with the United States Digital Millennium Copyright Act (17 U.S.C. § 512). If you are a copyright owner or an authorized agent thereof and believe that any content hosted on our site infringes upon your copyrights, you may submit a formal notification pursuant to the DMCA.
2. Before You Submit a Copyright Infringement Notice
Please consider whether the use of the material qualifies as "Fair Use" before submitting a takedown request. Technical documentation, educational code snippets, historical BIOS files, and hardware schematics may sometimes fall under fair use exceptions for education, research, reverse engineering, or repair. If you are unsure whether the material infringes your copyright, we strongly recommend consulting an attorney first.
3. Required Information for a Valid DMCA Notice
To file a valid copyright infringement notification with Clayi, your written communication must include substantially the following information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed, including the exact URL(s) where the material is located.
- Information reasonably sufficient to permit Clayi to contact you, such as an address, telephone number, and an email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
4. Designated DMCA Agent Contact Details
All formal DMCA takedown notices concerning content hosted on Clayi should be sent exclusively via email to our designated copyright agent:
- Contact Email: [email protected]
- Subject Line: DMCA Takedown Request - [Your Name / Company Name]
We only accept properly formatted written notifications sent to this email address. Please allow up to 48-72 business hours for a complete response and action.
5. Our Action and Review Process Upon Notification
Upon receipt of a valid, fully compliant DMCA notice, Clayi will take immediate steps to review the claim. If the notice satisfies all legal requirements, we will expeditiously remove or disable public access to the allegedly infringing material. We will also make a good-faith attempt to notify the user or contributor who originally posted the material, informing them of the removal and providing them with a copy of your notice.
6. Freedom of Counter-Notification for Users
If your content was removed due to a DMCA notice and you believe this occurred as a result of a mistake, misidentification, or that you hold the necessary rights to distribute the file, you have the right to file a Counter-Notification. To be effective, the counter-notification must be a written communication sent to our Designated Agent and must contain all legally required elements under 17 U.S.C. § 512(g)(3).
7. Required Information for a Counter-Notification
If you choose to file a counter-notice, your response must contain the following specific details:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location (URLs) at which the material appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, physical address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Clayi may be found, and that you will accept service of process from the person who provided the original DMCA notification.
8. Resolution of Disputes Following Counter-Notice
Upon receiving a valid counter-notification, Clayi will promptly forward a copy of it to the original complaining party. We will inform them that the removed material may be restored in 10 to 14 business days. Under the DMCA, we are legally required to restore the content within this timeframe unless the original copyright owner notifies our Designated Agent that they have filed a formal lawsuit seeking a court order to restrain the user from engaging in infringing activity relating to the material on Clayi.
9. Repeat Infringer Policy and Account Termination
Clayi maintains a strict zero-tolerance policy against chronic copyright violation. In accordance with Section 512(i)(1)(A) of the DMCA, we reserve the right to permanently terminate the accounts, access privileges, or contribution rights of any user, developer, or technician who is determined to be a repeat infringer. A repeat infringer is defined as any user who has been notified of infringing activity more than twice or whose content has been removed due to valid DMCA notices on multiple occasions.
10. Protection Against False Claims and Fraudulent Notices
Please be aware that under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material or activity is infringing may be held liable for damages. This includes legal fees, court costs, and financial damages incurred by Clayi, by any copyright owner, or by any website user who is injured as a result of our relying upon such misrepresentation to remove or disable access to the material.
11. Amendments and Updates to This Policy
Clayi reserves the right to modify, amend, or update the terms of this DMCA Notice & Takedown Policy at any time and for any reason without prior individual notice. Any changes will become effective immediately upon being posted on this webpage. We encourage our visitors, technicians, and community members to review this policy periodically to stay informed about our copyright compliance standards.
